At least, however, these were from large representative samples, face-to-face interviews took place, and there was some mixing of methods in the BWBS survey. The FTWS 2008 asked respondents if they labelled themselves as either being bullied or sexual harassed, presenting a minimalist definition. In the BWBS, survey respondents were asked about experiences from an adapted NAQ-type list. The responses were not, however, presented as enabling the researchers to measure the incidence of a predefined behavioural construct, but rather as analyses of self-reports of certain experiences recognizing that responses are influenced by individuals’ interpretive frames.
The book is therefore not organized around a traditional legal category. No general conception of prohibited (or required) workplace behaviour is the foundation for a single cause of action, nor is any such idea traditionally used by lawyers to make sense of legal intervention at work. Yet, first, there are many legal rules, all in the form of individual rights, that regulate conduct at work; second, conflict about behaviour is important, perhaps increasingly, to the lived reality of working lives, and third, there has been considerable non-legal and socio-legal research about negative workplace behaviour and related engagement with law.
